A 27-year-old Drouin man was bailed last week after being arrested in relation to rape charges and a Drouin home invasion.
Daniel Rice was arrested and charged by Baw Baw CIU detectives on November 24.
He was remanded and appeared at Latrobe Valley Magistrates' Court last Tuesday where the court was told he was an "unacceptable risk" to be released on bail.
Mr Rice was charged by SOCIT police in September with 10 offences including rape and sexual assault of two children under 16 and supplying drugs to children. The offences allegedly occurred in Warragul in July 2023.
He was arrested last week by Baw Baw detectives in relation to a home invasion incident in which he allegedly entered a Drouin home armed with a hammer in July 2021. The five charges also included recklessly causing injury, property damage and theft.
Other outstanding matters included seven driving offences relating to incidents in Cranbourne in August 2023 when he was allegedly driving whilst drug and alcohol affected.
Mr Rice also faced a charge of breaching a family violence intervention order in January 2021.
Opposing bail, prosecutor senior constable James said the accused had a "poor history of bail compliance" and was an an "unacceptable risk."
Sen const James told the court Mr Rice had been charged with two separate home invasions which showed "his propensity to violence."
Defence for Mr Rice told the court he had been difficult for police to track down because the previous Warragul address he was bailed to was unsatisfactory.
The court heard Mr Rice was avoiding the Warragul address because of "drug use" at the house and Mr Rice had been off marijuana for 12 months.
Mr Rice is facing "many mental health challenges at the moment" and wanted to go into rehabilitation care so he could support his partner and their new baby when it arrived in February, the court heard.
The magistrate was told Mr Rice had not offended for the past 12 months and he was "trying to do the right thing."
Magistrate Ann Collins said some of the charges were "very serious offending" and told Mr Rice the case against him was not weak.
While sen const James argued Mr Rice had not reached "exceptional circumstances" to be bailed, Ms Collins said Mr Rice's Aboriginality, mental health issues and physical health "gets him across the line."
Ms Collins said the other issue for her was he had been out of trouble for 12 months.
The magistrate told Mr Rice he was "very lineball in making bail."
"These are serious matters," she said, acknowledging he had "obviously done some work" to improve his position.
Mr Rice was bailed to a Drouin address. Part of his bail conditions is a curfew at the Drouin address between 9pm and 7am every day.
He will appear at Latrobe Valley Magistrates' Court on December 19 for a further bail hearing and a committal mention hearing was set for February 21.
